Her legal representatives confirmed her critical state on Friday, just two days after Tennessee authorities tried to execute her using two doses of pentobarbital.

Following the unsuccessful execution, the 50-year-old inmate was transported to a Nashville-area hospital. Her attorneys, Stephen Ferrell and Luke Ihnen, stated that she is undergoing medical care for the adverse effects of the drug, noting severe injuries to both her arms. In their official statement, the lawyers declared, “She is being treated for the serious effects of the pentobarbital administered during the execution attempt, including significant injuries to both arms.” Subsequently, they lodged an emergency application with a Nashville court, seeking an order for the Tennessee Department of Correction to secure all evidence pertinent to the failed procedure.

Christa Pike's execution by lethal injection was initially slated for Wednesday at the Riverbend Maximum Security Institution in Nashville. According to media present, she reportedly showed signs of life even after the initial dose of pentobarbital was given, necessitating a second dose. Witnesses further noted hearing her breathing and snoring post-administration of the drugs. In contrast, the Tennessee Department of Correction maintained that its actions adhered strictly to the state's sanctioned execution protocol. A statement from the department affirmed, “The Tennessee Department of Correction followed every step of the State’s lawful, established execution protocol approved by the Attorney General’s Office.” The agency also highlighted the consistent efficacy of the lethal injection chemicals used and confirmed that their procedure does not allow for actions beyond those already performed.

In response to the incident, Tennessee Governor Bill Lee has mandated an independent third-party investigation and indefinitely suspended the state’s upcoming scheduled execution. Governor Lee emphasized the state's need to understand why this particular outcome diverged from prior executions. Meanwhile, Pike’s legal team is advocating for a commutation of her death sentence, asserting that she endured significant physical harm during the unsuccessful execution attempt.

Her lawyers had earlier informed the courts about Pike’s challenges with intravenous access, attributing it to her underlying medical condition and constricted veins. This failed execution has also ignited a legal debate regarding the implications when an inmate survives after being administered lethal injection drugs.

Pike received her death sentence for the 1995 murder of Colleen Slemmer, a 19-year-old peer from Job Corps. Her conviction in 1996 stemmed from her guilt in Slemmer's killing within a secluded part of the University of Tennessee Agricultural campus. At the time of the crime, Pike was 18 years old. Had her execution proceeded as planned, she would have been the first woman to be executed by Tennessee in over two centuries.

This particular instance stands out as most prior failed lethal-injection executions in the US typically involved difficulties in establishing an intravenous line before drug administration. However, legal analysts quoted in American media highlight that Pike’s situation is distinct because the lethal chemicals were administered, yet she remained alive. Historical records show instances of prisoners surviving failed executions and subsequently facing another attempt. For example, in 1947, 16-year-old Willie Francis survived an electric-chair execution in Louisiana due to a malfunction. His subsequent appeal against a second execution was rejected by the US Supreme Court, and he was executed the following year. Similarly, in 2009, Ohio authorities struggled to establish an IV line during an attempt to execute Romell Broom. The Ohio Supreme Court later determined that a second execution would not infringe upon the US Constitution’s double jeopardy protections. Broom ultimately died of COVID-19 in 2020, still on death row.

Currently, Pike’s lawyers are focused on preserving evidence from Wednesday’s execution as her medical and legal fate hangs in the balance. The state government has yet to declare if it will pursue another execution date following the conclusion of the independent review.
