Anambra State Introduces Plea Bargain Initiative to Ease Prison Congestion

In a bid to reduce the congestion in correctional facilities and accelerate the administration of justice, the Anambra State Government has unveiled a plea bargain policy. This initiative, which was announced by the state's Attorney General and Commissioner for Justice, Tobechukwu Nweke, in a statement, applies to suspects standing trial for various crimes in the state. However, it does not cover serious offences such as murder, kidnapping, armed robbery, and rape. According to Nweke, the policy is part of the state government's broader efforts to reform the justice sector, as envisioned by Governor Chukwuma Soludo. The attorney general has directed prosecutors in the state to issue plea bargain forms to defendants in eligible cases before they enter their pleas. This directive, which took effect on July 22, 2026, aims to operationalize plea bargaining in the administration of criminal justice in Anambra State, in line with the provisions of the Administration of Criminal Justice Law of Anambra State, 2022. Under this policy, defendants will have the option to plead guilty to a crime in exchange for a reduced sentence or other concessions, subject to the approval of the court. The plea bargain form will be signed by the defendant and submitted to the prosecutor or the Ministry of Justice. Any charge or information initiated without the issuance of the plea bargain form may be discontinued. The policy is expected to ease the burden on the courts and strengthen the criminal justice system in the state.
