Nollywood veteran, Actress Rita Edochie, has issued a strong statement asserting the illegality of a woman identifying as a wife to any man whose existing statutory marriage has not been legally annulled. Her declaration, shared on her Instagram page on Tuesday morning, comes amidst her ongoing legal battle with Judy Austin, who is recognized as the second wife of her nephew-in-law, Yul Edochie.

Edochie emphasized that neither the acceptance of a family nor the grandeur of a wedding ceremony can validate a subsequent marriage if the man's initial statutory union remains legally active. She articulated her stance with a series of pointed remarks, including: 'I MUST ENTER THE AJAH MANSION BY FIRE BY THUNDER.... YOU WISH...... DESPERATION CAN MAKE YOU IGNORE THE RED FLAG.......... STOP CALLING YOURSELF A “SECOND WIFE” WHEN THE MAN HAS NOT LEGALLY DIVORCED HIS FIRST WIFE YOUR FEELINGS , HIS PROMISES , AND YOUR IGNORANCE OF THE LAW DO NOT MAKE AN INVALID MARRIAGE VALID !'

She further elaborated on the legal framework, stating, 'A MAN WHO HAS CONTRACTED A STATUTORY MARRIAGE CANNOT SIMPLY DECIDE THAT THE MARRIAGE IS OVER AND MOVE ON TO MARRY ANOTHER WOMAN UNDER THE SAME LAW . UNTIL THE FIRST MARRIAGE IS PROPERLY DISSOLVED , IT REMAINS A SUBSISTING MARRIAGE . LIVING APART , FIGHTING , STOPPING COMMUNICATION OR EVEN HAVING CHILDREN WITH ANOTHER WOMAN DOES NOT AUTOMATICALLY END IT .'

The actress cautioned individuals against self-deception, highlighting that a man's assertion of his first wife no longer being his spouse does not establish a legal fact. Similarly, family acceptance or a lavish wedding cannot nullify an existing statutory marriage, nor can a man's promise serve as a divorce decree. She urged against allowing emotions to overshadow legal realities, stressing that the law prioritizes the legal status of an existing marriage over private narratives.

Rita Edochie warned of serious legal repercussions where a subsequent statutory marriage is contracted while the first remains subsisting, potentially rendering the new union void. She advised women considering the 'second wife' title to first ascertain if the initial marriage has been legally dissolved.

Addressing the complexities of inheritance, Edochie debunked common misconceptions, clarifying: 'IT IS WRONG TO SIMPLY SAY THAT THE SECOND WOMAN AUTOMATICALLY INHERITS NOTHING WHILE THE FIRST WIFE AUTOMATICALLY INHERITS EVERYTHING . SUCCESSION CAN DEPEND ON A WILL , THE APPLICABLE LAW , OWNERSHIP OF THE PROPERTY , CHILDREN AND OTHER LEGAL CIRCUMSTANCES . INHERITANCE IS NOT A MATTER OF WHO SHOUTS THE LOUDEST ON FACEBOOK .'

She concluded by reiterating the importance of understanding legal provisions before accepting a man's word about marital status.
