A recent court verdict has ignited significant public outcry after a father, Stephen Vincent Chavez, who confessed to an incestuous relationship with his biological daughter, was spared a state prison sentence this week.

Forty-one-year-old Stephen Vincent Chavez received a sentence of one year in jail along with three years of felony probation. This follows his guilty plea in May 2026 to a single felony count of incest and a misdemeanor charge of supplying alcohol to a minor, as confirmed by the Ventura County District Attorney’s Office. Prosecutors had pushed for the maximum possible punishment, describing the incident as a severe breach of trust and parental authority.

However, an open plea agreement presented directly to Ventura County Superior Court Judge Dusty Kawai circumvented the prosecution's recommended sentencing. Under California law, felony incest carries a maximum sentence of three years. Judge Kawai stated he was legally unable to impose this maximum term due to the defendant's lack of a prior criminal record. Prosecutors also revealed they had explored the possibility of filing additional charges, including rape, but concluded that incest was the only felony charge supported by existing law, evidence, and admissible facts.

The case originates from events in July 2025, when Chavez’s daughter, Makayla Rene Settles, was staying at his Moorpark residence. Prosecutors reported that the situation escalated after a family gathering where alcohol was consumed. Subsequently, Chavez purchased more alcohol for himself and his daughter to drink at home. The district attorney’s office stated in a news release, “After a day of drinking at a family gathering, Chavez purchased additional alcohol for himself and his daughter to consume at home. Chavez then engaged in s£xual intercourse with her.” Makayla tragically died by suicide in December 2025 at the age of 18.

Chavez’s sentence has triggered intense backlash, particularly given that prosecutors had sought a three-year state prison term, a request the court ultimately denied. “Several members of Makayla’s family addressed the court during sentencing and provided emotional victim impact statements describing the lasting trauma caused by the defendant’s actions and the devastating loss of Makayla,” the news release highlighted. Deputy District Attorney Tessa McCarty strongly condemned Chavez’s actions, labelling them a blatant betrayal of parental trust. McCarty asserted, “Chavez exploited his position as a father, violated his daughter’s trust, supplied her with alcohol, and engaged in criminal conduct that forever altered the course of her life.” She further added, “While we respect the court’s decision, we continue to believe a state prison sentence was warranted under the facts of this case.”
